Automattic Inc. and WooCommerce, Inc., through their legal representatives, are demanding that WP Engine cease all unauthorized use of their trademarks (WORDPRESS, WOOCOMMERCE, and WOO). They insist that WP Engine remove all offerings, advertisements, and marketing materials using these trademarks from websites, social media, and other locations. Additionally, they demand an accounting of all profits derived from services using these trademarks, compensation for unauthorized use (suggesting a figure of over $32 million annually based on an 8% royalty), and implementation of a legal hold to preserve all relevant data and documents. The letter indicates willingness to resolve the matter through a licensing agreement but threatens civil litigation if their demands are not met. WP Engine is given until October 3, 2024, to confirm compliance with these requests.
